Terms of Service

Terms and Conditions of BDY PSA, a company incorporated and registered in Poland whose registered office is at Twarda 18, 00-105, Warszawa, referenced in this document as "Buddy". Please read carefully this agreement before using the buddy.works web site or the Continuous Integration and Delivery platform (CI/CD) the company provides ("Service"). By clicking the confirmation button on the sign-up form, you ("Customer") agree to become bound by the Terms and Conditions ("Terms of Service") of this agreement, to the exclusion of all other terms. Buddy reserves the right to update and change the Terms of Service at any time but if we do, we will bring it to your attention by placing a notice on the site, by sending you an email, and/or by some other means.

Scope of the Service

  • Buddy is a Continuous Integration and Delivery tool (CI/CD) for web and software developers. It is a subscription based platform distributed in cloud and on-premises standards. It allows users to create delivery pipelines to build, test, and deploy code. The pipelines consist of actions (over 120 types) that can be easily arranged with drag and drop in a clear and telling GUI – there is no need to script the whole process.
  • Buddy supports all popular languages and frameworks, including PHP, Node.js, Java, Go, Python, Rails, .NET Core, and mobile tech (Android, Ionic, React Native). Builds and tests are run in isolated Docker containers, with the artifacts and repository files stored in the pipeline filesystem. Dependencies and packages are cached in the filesystem, which massively improves build performance.

Automation Pipelines

  • DevOps is a set of good practices that enables organizations to deliver new features to users as fast and efficiently as possible. The core idea of automation is to create a repeatable, reliable and incrementally improving process for taking software from concept to customer.
  • The goal of Continuous Delivery is to enable a constant flow of changes into production via an automated software production line. The Continuous Delivery pipeline is what makes it all happen.
  • Successful adoption of Buddy pipelines is driven by a deep understanding that there is no such thing as a standard pipeline. This is why Buddy has made its automation pipeline extremely flexible in nature.

How Pipelines Work

  • The basic building blocks of Buddy are actions. These are steps that Buddy executes in a pipeline. Each pipeline can have an infinite number of steps. Users start to build their automation pipelines by choosing the first action that they want to execute and continue from there.
  • Pipelines can be run manually or configured to be executed automatically on every code push or at a specific time. Thanks to it any DevOps task - such as builds, test automation, continuous deployments, monitoring and automated backups of production data - can be handled easily.

  • The cloud standard of Buddy service requires a stable internet connection and will run on all web browsers above IE11.

Account terms

  • You must be 13 years old or more to use the Service.
  • You must provide your correct data: a valid email address, and any other information required for the signup process.
  • You are responsible for keeping the privacy and safety of your account. Buddy cannot be and would not be responsible for the damages or losses ensuing as the result of your failure to protect your login information, including your password.
  • One person cannot keep more than one free account.
  • You must be human. Accounts registered by automatic machines are forbidden.
  • Your login can be used only by one person. A co-login between two or more persons is forbidden.
  • If you use a free account you cannot block advertising.
  • You cannot use the Service for purposes forbidden by law. By using the Service you cannot break any law and jurisdiction, especially emphasizing copyright law.

Billing

  • Registering to the Service starts 14 days of free trial with 1 concurrent execution run and no limit on disk space, number of users, and number of projects. When the trial is over, the workspace will switch to read-only mode and you will be asked to choose your plan. Plans that exceed your current resource consumption will be greyed out and will not be available until you reduce the usage by deleting some of your projects.
  • Credit card or PayPal account is needed to continue using the Service after the trial period (making use of a finite number of releases).
  • The Service is paid monthly in advance. You would be charged monthly with the costs according to the type of account chosen by you. If you register for the paid account and within 30 days from the registration date you will not cancel the Service, you will be charged every month starting from the moment of the first registration and the invoice will be issued only for the initial charge.
  • With upgrade or downgrade of your account, you will automatically be charged according to the new rates at the next accounting period.
  • Downgrade of the account can result in losing a part of your resources or functionality. Buddy is not responsible for such losses.
  • VAT shall be added to all the prices according to the effective rates.

Service Level Agreement (SLA)

  • The SLA outlines our guarantee that your Buddy workspace and repositories hosted on Buddy will be available through your assigned app.buddy.works subdomain 100% of the time in a given month (excluding scheduled maintenance).
  • Scheduled maintenance time occurs on Tuesday between 8:00 AM and 8:05 AM CET (non-US countries), and between 8:05 and 8:10 AM CET (USA). Buddy may be required to periodically schedule emergency maintenance with advance notice not later than 2 days before maintenance.
  • Technical support is accessible for paid accounts via email and online chat with the expected response time of 24 hours during the working days and 48 hours during the weekends and holidays. Accounts on the Hyper plan are served with top priority (1 hour of expected response time during standard 12/5 support hours).
  • If an outage occurs, we will issue a credit to your next bill for 5% of your monthly fee for every 30-minute period of downtime, up to 100% of your fee for the month.
  • This SLA does not apply to downtime resulting from Customer's equipment or third-party equipment, or both. This SLA applies to the primary repository hosting service and excludes any services or tools not explicitly mentioned, including but not limited to deployment and integrations with 3rd-party services. This SLA does not apply to any performance issues caused by Force Majeure, i.e. events independent from the service provider that could not have been predicted and prevented.
  • Customers must request the credit from Buddy within 30 days of the outage. Failure to contact Buddy within 30 days will result in a forfeiture of the Customer's right to receive the credit. No cash refunds will be provided.

Refund Policy

  • It is refundable only when the refund of a payment was requested not later than 10 days after the payment has been registered. There would be no returns for partial usage of the service or for the period when your account was canceled.
  • A request for a refund shall be sent to Buddy Support at support@buddy.works. The request will be processed within 5 working days.
  • Refund is possible only for month preceding filing the request and only if your account has not been used unless there are other legal grounds for refund to be granted.

Cancellation and Termination

  • You can cancel your account at any time by sending a request to Buddy Support at support@buddy.works. This is the only way of canceling the Service.
  • Your account and all its content would immediately be removed after the cancellation of the account. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements, but barring legal requirements, we will delete your full profile and the Content of your repositories within 30 days of cancellation or termination (though some information may remain in encrypted backups). This information can not be recovered once your account is canceled.
  • Upon request, we will make a reasonable effort to provide an account owner with a copy of your lawful, non-infringing account contents after account cancellation, termination, or downgrade. You must make this request within 30 days of cancellation, termination, or downgrade.
  • You can cancel the account any time: however, you will be responsible for all payments arising from using the service at the end of full accounting month. In the next accounting month you will not be charged.
  • Buddy reserves the rights to cancellation of the account, suspension or change with prior notice, but without refund with the rules described below
  • Account can be canceled or suspended in the following cases: (a.) any payment is due but unpaid by 6 months, (b.) a material breach of any provision of this Terms of Service.
  • Suspended account will switch to read-only mode.
  • Suspended account can be restored, in particular if you justify the violation of the Terms of Service, depending at decision taken by Buddy.
  • Cancellation includes deleting your full profile and the content of your repositories (though some information may remain in encrypted backups). This information can not be recovered once your account is canceled.
  • Account can be changed in the case of modification of the Service in compliance with provisions presented further herein.

Cancellation and Termination of Free Accounts Due to Inactivity

  • Buddy reserves the rights to cancellation of free accounts showing no signs of usage. By "free account" we mean a workspace after the trial period with the free plan selected.
  • After one month with no activity registered in the free account, we will send a notification email to the account owner. By "activity" we mean logging manually into the account at least once in 30 days. Triggering pipelines remotely with commits or webhooks without accessing the GUI is NOT considered activity.
  • If after notification there is still 30 days of no activity registered, the account will become suspended and will be marked for deletion. From this moment onwards, the user has 30 days to contact Buddy's support in order to restore the account.
  • If after notification there is still 60 days of no activity registered , the account will be permanently canceled. This includes deleting your full profile and the content of your repositories (though some information may remain in encrypted backups). This information can not be recovered once your account is canceled.

Modifications to the Service and Fees

  • Buddy reserves the right to temporarily suspend the service or modify it according to company's will at any time and right to change the rates for Service and other clauses of the Terms and Service to a reasonable extent.
  • You shall be notified of such suspensions, modifications, and changes by e-mail no later than 7 days prior to such change entering into force. In conjunction with such change and significant suspension or modification, you shall be entitled to cancel your account with effect on the day upon which the change, significant suspension or modification is to take effect. Buddy shall inform you in its notice of your right to cancel the account. If you do not cancel the account before such change, significant suspension or modification takes effect, you shall be deemed to have accepted such change, significant suspension or modification.
  • In case of early cancellation pursuant to the provisions cited above, when you have made payment related to a period after the cancellation, Buddy will repay the exceeding amount within 30 days from cancellation of the account.
  • Buddy is not responsible for the effects of modifications to the system payment changes or ceasing the Service provision.

Copyright and Content Ownership

  • Buddy considers the contents of repositories hosted on the Service to be confidential to you.
  • Buddy will protect the contents of repositories hosted on the Service, as well as server authentication data, integrations details, and encrypted environment variables, from unauthorized use, access, or disclosure in the same manner that we would use to protect our own confidential information of a similar nature and in no event with less than a reasonable degree of care.
  • Buddy does not claim any rights to intellectual property uploaded by you to the Service.
    Buddy reserves the right to discard and delete content in the Service.
  • Buddy does not allow third parties to access the contents of your projects and files included. Buddy stores and processes them to make the Service functional: however, all these processes are automated.
  • Buddy employees may only access the content of repositories hosted on the Service in the following situations:

    1. With your consent and knowledge, for support reasons. If Buddy accesses a repository for support reasons, we will only do so with the owner''s consent and knowledge.
    2. When access is required for security reasons.
  • Buddy reserves the right to any and all protected components of its Service, including but not limited to: name of service, design, artwork and individual features. You cannot copy, modify, adapt, distribute, reverse engineer and decompile any part of the Service which is in the possession of Buddy or persons who created them.
  • You shall not sell, license, rent, or otherwise use or exploit any content for commercial use or in any way that violates any third-party right.

Information rights and publicity

  • Unless you notify Buddy otherwise in writing, You hereby grant to Buddy and its wholly owned subsidiaries a limited license to use Your trade names, trademarks, service marks, logos, domain names and other distinctive brand features in presentations, marketing materials, websites, customer lists, and financial reports.

Client Data

  • All data uploaded by the Users belong to the Users. Buddy does not claim any rights to intellectual property uploaded by the Users.
  • Despite that Buddy hosts all data entered by the user, the ones all the time belong to the user. Buddy will never sell or by purpose make accessible the data entered by the user to the third-party as well as will never use them for the benefit of his own business. Our procedures obey the privacy of our users and their data.

Tracking

  • If you do not want online services to collect and share certain kinds of information about your online activity from third-party tracking services, you can set the Do Not Track privacy preference in your browser.
  • We do not track your online browsing activity on other online services over time and we do not permit third-party services to track your activity on our site with the exception of basic Google Analytics tracking and occasional user behavior tracking performed with PostHog analytics tool. The tracking data is collected exclusively to improve the UX and performance of the Service and website.

General Regulations and Rules of Conduct

  • You use the delivered Service "as-is" and "as available" at your own risk.
  • You are aware that your data and its processing can be transferred in a not cryptic transmission by any kind of web and net devices.
  • You agree that you will not transmit, distribute, post, store, link, or otherwise traffic in content, information, software, or materials on or through the Service that (a.) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, offensive, profane, contains or depicts pornography that is unlawful, or is otherwise inappropriate as determined by us in our sole discretion, (b.) you know is false, misleading, untruthful or inaccurate, (c.) constitutes unauthorized or unsolicited advertising, (d.) impersonates any person or entity, including any of our employees or representatives, or (e.) includes anyone's identification documents or sensitive financial information
  • You shall not (a.) take any action that imposes or may impose (as determined by us in our sole discretion) an unreasonable or disproportionately large load on our (or our third-party providers') infrastructure; (b.) interfere or attempt to interfere with the proper working of the Services or any activities conducted on the Services; (c.) bypass, circumvent or attempt to bypass or circumvent any measures we may use to prevent or restrict access to the Services (or other accounts, computer systems or networks connected to the Services); (d.) run any form of auto-responder or "spam" on the Services; (e.) use manual or automated software, devices, or other processes to "crawl" or "spider" any page of the Website; (f.) harvest or scrape any Content from the Services; (g.) use the Services for high risk activities including but not limited to the operation of nuclear facilities, air traffic control, life support systems, or any other use where the failure of service could lead to death, personal injury, or environmental damage; or (h.) otherwise take any action in violation of our guidelines and policies.
  • It is strictly forbidden to use the service to mine Bitcoin and other cryptocurrencies. Such activity will result in immediate suspension of the account and legal action against the workspace owner.
  • You shall not (directly or indirectly): (a.) decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Services (including without limitation any application), except to the limited extent applicable laws specifically prohibit such restriction, (b.) modify, translate, or otherwise create derivative works of any part of the Services, or (c.) copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder. You shall abide by all applicable local, state, national and international laws and regulations.
    Buddy does not guarantee that the Service will meet your individual requirements, act continuously, there will be no errors, be safe or timely, the outcome of the service will be precise and reliable and that all errors will be repaired. The same applies to all products, services and materials bought or acquired by the Service.
  • Some parts of Buddy functionality may not work with your hardware/software or other third-party services (ex: hosting providers).
  • You understand and accept that Buddy is not liable for any direct, indirect, casual, special, consequential or exemplary damages, including but not limited to damages or loss of profits, goodwill, data or other intangible losses - even when Buddy has been warned about the possibility of such damages.
  • The Terms of Service constitute the conditions of the contract between Buddy and you and define the rules of using the Service.
  • If any provision of the Terms of Service is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby.
